Do I Really Need a Personal Injury Lawyer?

Yes,  and the right personal injury lawyer could mean the difference between nothing and everything.

A woman in Poughkeepsie was rear-ended at a red light. No broken bones. She accepted a quick settlement. Six weeks later, she was diagnosed with a herniated disc. Eight months of therapy. Eleven weeks out of work. The settlement covered her ER visit and nothing else.

Once you sign, you cannot go back. At Fakhoury Law, attorney Michael A. Fakhoury has seen this happen for over 25 years across Dutchess County. This article gives you the full picture before you decide.

Is Hiring a Personal Injury Lawyer Actually Worth the Cost?

The question assumes there is an upfront cost. There is not.

Fakhoury Law works on a contingency fee basis. You pay nothing unless you win. No retainer. No hourly bills. No out-of-pocket fees while your case is active.

So the real question is this: what do you risk by going it alone?

People with legal representation receive an average settlement of $77,600. People without a lawyer average $17,600. And 91% of represented victims receive a settlement at all, compared to just 51% of those without an attorney.

A quick settlement feels like relief. Most of the time, it is a discount.

What Does New York Law Actually Require You to Prove?

This is where most self-represented victims get blindsided.

New York is a no-fault state. Under Insurance Law Section 5103, your own insurance pays your medical bills and lost wages first, up to $50,000, regardless of who caused the crash.

But no-fault does not cover pain and suffering. It does not cover losses above $50,000.

To sue the at-fault driver for those damages, you must prove what New York defines as a “serious injury” under Insurance Law Section 5102(d). Qualifying injuries include:

  • A bone fracture
  • Significant disfigurement
  • Permanent limitation of a body organ or function
  • Any injury that prevents normal daily activities for at least 90 of the first 180 days after the accident, known as the 90/180 rule

Insurance companies fight this threshold every single time. They look for gaps in your medical treatment. They argue your injury existed before the accident. They dispute your doctor’s findings.

The adjuster who called you the day after your crash already knows this law. The question is whether you do.

How Long Do You Have to File a Claim in Dutchess County?

Deadlines in New York personal injury law are absolute. Miss them, and your case is gone, no matter how strong your evidence is.

Here is what you need to know:

  • Standard personal injury – Under CPLR Section 214(5), you have 3 years from the date of your injury to file a lawsuit.
  • Medical malpractice – Under CPLR Section 214-a, you have 2 years and 6 months from the negligent act or the end of continuous treatment.
  • Wrongful death – Under EPTL Section 5-4.1, surviving family members have 2 years from the date of death.
  • Government entities – If your accident involved a city vehicle, a public bus, or a dangerous public road in Dutchess County, a Notice of Claim must be filed within 90 days. The lawsuit must be filed within 1 year and 90 days.

Three years sounds like plenty of time. It is not. Surveillance footage gets deleted in days. Witness memories fade in weeks. The earlier an attorney starts building your case, the more evidence survives.

What Happens When You Face the Insurance Company Alone?

Here is what that actually looks like.

The adjuster calls. They are calm, professional, and already know three things you do not: what your injury is worth under New York law, what the 90/180 rule requires you to prove, and that a recorded statement made now can be used to reduce your claim later.

They ask how you are feeling. You say you are sore but okay. That answer just became part of your file.

They offer $8,500. You are stressed, your car is damaged, and bills are coming in. You sign.

The offer looked fair. It did nothing for your actual losses.

That is not an accident. That is a system built to close claims before injured people understand what they are owed.

What Does Fakhoury Law Actually Do for You?

Attorney Michael A. Fakhoury graduated Magna Cum Laude, clerked for Judge Jeremiah E. Berk, and has recovered over $60 million in settlements and verdicts for injury victims across Dutchess County and the Hudson Valley. His results include a $5.3 million spinal cord injury settlement and a $3.6 million medical malpractice verdict.

Here is what that experience looks like working for you:

  • Investigate before evidence disappears – Scene visits, police reports, witness interviews, and full medical record review
  • Handle all insurer communication – No recorded statements, no pressure calls, no lowball tactics reaching you directly
  • Calculate your full damages – Current medical costs, future treatment, lost wages, lost earning capacity, and pain and suffering
  • Negotiate with real leverage – Insurers know which attorneys take cases to trial. That changes what they offer.
  • Litigate if needed – When a fair settlement is not on the table, Fakhoury Law goes to court

Throughout it all, you pay nothing unless you win.
